Kipsy Terms of Use

These terms apply to your use of the Kipsy Android app, made by YCJW FBA LLC ("we", "us"). By using Kipsy you agree to them. If you do not agree, please do not use the app.

1. Using Kipsy

We give you a personal, non-exclusive, non-transferable license to use Kipsy on devices you own or control, subject to these terms and the Google Play Terms of Service.

2. What you record

Kipsy records audio and video that other apps play on your device. You are responsible for what you record and how you use it. Record only content you have the right to record, follow the terms of the apps and services you use, and respect copyright. Kipsy is meant for personal study and review. Do not use it to copy, redistribute or publish content that is not yours.

3. Free use and Premium

• Every feature is free, with up to 10 recordings kept. Premium removes that limit.
• Premium is sold through Google Play as a monthly or yearly subscription, or as a one-time lifetime purchase. The price is shown in Google Play before you buy.
• Subscriptions renew automatically at the end of each period until you cancel. Cancel any time in Google Play › Payments & subscriptions › Subscriptions. Premium stays active until the end of the period you paid for.
• If a free trial or introductory price is offered, its terms are shown before you subscribe. Unless you cancel before it ends, the regular price is charged when it ends.
• Payments, cancellations and refunds are handled by Google Play under its policies. For a refund, request one through Google Play, or contact us and we will help where we can.
• If Premium ends, the recordings you have stay on your device and can still be played. New recordings can be kept again once your library is within the free limit.

4. Subtitles

Subtitles are made automatically and may contain mistakes. Do not rely on them where accuracy matters.

5. Your data

Your recordings stay on your device, as described in the Privacy Policy. Keep your own copies of anything important: uninstalling the app removes its data, and we cannot recover it.

6. Changes to the app and these terms

We may update Kipsy and these terms. If we change the terms in a meaningful way, we will update this page and its effective date. Continuing to use Kipsy after a change means you accept the new terms.

7. Disclaimer

Kipsy is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. We do not promise that the app will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, YCJW FBA LLC is not liable for indirect, incidental, special or consequential damages, or for loss of data, arising from your use of Kipsy. Our total liability for any claim is limited to the amount you paid for Kipsy in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you.

9. Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules, except where the law of your place of residence requires otherwise.
